User Agreement for Eimer Engineering Services & data capture

1. By using the services of Eimer Engineering, the user agrees to allow Eimer Engineering complete access to all imagery, data or scans taken ”user provided info” in the course of providing services.

2. The user acknowledges that the “user provided info” may be used for the purposes of improving Eimer Engineering's services, as well as for internal research and development.

3. The user agrees that Eimer Engineering may share the ”user provided info” with third parties for the purpose of improving services or for research and development, provided that the third party is bound by confidentiality obligations.

4. The user agrees that Eimer Engineering may retain the ”user provided info” for an unlimited period of time.

5. The user agrees to indemnify and hold Eimer Engineering harmless from any claims arising from the ”user provided info” as permitted in this agreement.

6. This agreement shall be binding upon the user, their successors and assigns.

7. This agreement shall be governed by and construed in accordance with the laws of the state of incorporation of Eimer Engineering.

8. This agreement contains the entire understanding of the parties with respect to the ”user provided info” and supersedes all prior agreements and understandings between the parties with respect to such subject matter.

9. This agreement may be executed in counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument.

10. Any disputes arising out of or related to this agreement shall be resolved through arbitration in accordance with the rules of the American Arbitration Association.

By using the services of Eimer Engineering, the user acknowledges that they have read and understand this agreement and agree to be bound by its terms and conditions.
